Terms and Conditions
A. DEFINITIONS
In these Terms and Conditions, the following definitions apply:
-“Accommodations”: Refers to the lodges, hotels, tented camps, and/or camping facilities that we book and pay for on your behalf.
-“Agent”: A third party you have authorized to communicate with us, provide information, and/or confirm and book your Tour.
-“Booking Confirmation”: Our letter to you confirming your Itinerary, Services, Accommodations, Deposit, and Quoted Price, as revised from time to time.
-“Contract”: Comprises these Terms and Conditions and your Booking Confirmation, excluding any presentations such as Wetus or Loom videos, emails, or other communications.
-“Deposit”: The non-refundable percentage of the Quoted Price that you must pay to confirm your booking.
-“Full Payment”: 100% of the Quoted Price.
-“Inherent Risks”: All possible risk factors and dangers associated with your Tour, including but not limited to:
– Rough roads
– Temperature extremes (heat, humidity, cold)
– Dirt and dust
– Wind
– Rain, snow, or ice
– Walking on rough ground
– Climbing stairs
– Climbing, including risks of falling stones and rock slides
– High altitudes
– Equipment failures, including safari car failures
– Animals
– Insects, snakes, or spiders
– Diseases and illness
– Getting lost
– Inaccessibility to medical care
– Difficulty in evacuation from remote locations in case of a medical emergency.
-“Itinerary”: The dates of your Tour and a brief description of each day.
-“Quoted Price”: The total price charged for your Tour.
-“Services”: The national park fees, reserve fees, concession fees, activities, primate trekking permits, flights, boats, transfers, and/or any other services we book and pay for on your behalf.
-“Worth” or “us” or “we”: Worth of Africa.
-“Start Date”: The first day of your Tour.
– “Tour”: Your Accommodations, Itinerary, and Services.
-“You” or “your”: Each person listed in the Booking Confirmation.B. BOOKINGS
1. If you are using an Agent, you confirm that the Agent acts with your full authority and you agree to be bound by any actions of the Agent. You are responsible for the correctness of all information provided to us by the Agent.
2. Upon confirming your Itinerary, Accommodations, and Services, you will receive a Booking Confirmation.
3. All confirmed bookings are subject to these Terms and Conditions. A booking is confirmed and a binding contract is created between Worth of Africa and you when we receive:
– The Deposit, or
– Full Payment if the booking is made less than 45 days before the Start Date.
4. No contract exists between you and us until the Deposit or Full Payment, as outlined above, has been received. These Terms and Conditions and your Booking Confirmation form the Contract between us.
5. It is your responsibility to seek clarification from us for anything unclear in either the Booking Confirmation or these Terms and Conditions.
6. By making a confirmed booking with us, you agree that you have read, understood, and agree to be bound by these Terms and Conditions.
7. The Deposit is completely non-refundable.
8. Confirmed bookings cannot be transferred to another date or person.
9. The lead booking name is responsible for making Full Payment for all persons in the booking party and ensuring that all members of the booking party (including any added or substituted later) are aware of and have read these Terms and Conditions.
10. By proceeding with the booking, all members of the booking party agree that they have read, understood, and agree to be bound by these Terms and Conditions. Parents/guardians agree on behalf of any minor children in the booking party.
11. The lead booking name also agrees to provide us with the correct nationalities, dates of birth, passport numbers, and scanned copies of passport photo pages for all members of the booking party.C. PROVISION, ALTERATION, OR CANCELLATION OF THE SERVICES OR ACCOMMODATIONS
12. Worth of Africa will provide the Services and Accommodations to you, except as outlined below.
Force Majeure
13. Worth of Africa reserves the right to alter or cancel the Services and/or Accommodations due to force majeure at any time. Force majeure refers to any event that Worth of Africa or the supplier of services and/or accommodations could not foresee or avoid with due care. Such events include but are not limited to war, civil unrest, industrial disputes, terrorist activities, natural disasters, pandemics, technical issues with transport, flight cancellations, airport or port congestion, adverse weather conditions, and similar events beyond our control.
14. No refunds or compensation will be provided if we need to alter or cancel any agreed-upon Services and/or Accommodations due to force majeure.
During Your Tour
15. During your Tour, Worth of Africa reserves the right to alter or cancel any agreed-upon Services and/or Accommodations due to unforeseen circumstances such as road closures, weather conditions, security issues, border closures, or other reasons beyond our control. We will endeavor to minimize alterations and cancellations, but you must accept that local conditions in Africa are unpredictable and delays and diversions from the planned route may be necessary.
16. No refunds or compensation will be provided if we need to alter or cancel any agreed-upon Services and/or Accommodations due to unforeseen circumstances. We will make every reasonable effort to ensure the same quality and character of the Services and/or Accommodations and to minimize inconveniences, but cannot be responsible for matters beyond our control.
Before Your Arrival
17. Worth of Africa reserves the right to make minor alterations to your Itinerary, Services, and/or Accommodations before the Start Date. We will advise you of these alterations in writing at the earliest possible date. Minor alterations include but are not limited to changes in internal flight schedules in Tanzania, tour departure schedules by more than four hours, changes in activity providers, or changes in Accommodations of similar quality, location, and price.
18. No compensation or refunds will be provided for minor alterations.
19. If major alterations to your Itinerary, Services, and/or Accommodations are required before the Start Date and are not due to force majeure or other factors beyond our control, you have the option to accept the altered Itinerary, Services, and/or Accommodations or cancel the Tour and receive a full refund of all monies paid.
20. Major alterations include but are not limited to changes in internal flight schedules in Tanzania, tour departure schedules by more than four hours, or changes in the standard, location, or price of Accommodations.
21. We will not pay any compensation beyond the refund of all monies paid.D. ITINERARY CHANGES
22. If you wish to change your Tour after the Deposit has been paid, we will do our utmost to accommodate the changes, provided that notification is received in writing.
23. Once the Deposit has been paid, the fee to change your Itinerary is $100 per person in addition to any other fees such as cancellation penalties, airline fees, or fees passed on to us from hotels or local operators.
24. Any requests for changes to your Tour within 60 days of your arrival date are subject to cancellation fees.
25. Should you wish to change your Itinerary during your Tour, we will assist you if possible, but you must pay a change fee of $100 per person plus any additional costs arising from the requested changes.
26. No refunds will be provided for any unused Services and/or Accommodations due to changes during your Tour.
27. We are not responsible if your Tour needs to be changed due to changes in international or local flight schedules that delay your arrival. You must pay any additional costs arising from such changes.E. PRICES
28. All Quoted Prices are in US dollars (USD) or Euros per person, based on known costs at the time we provide your Booking Confirmation.
29. Prices for children are based on the ages provided to us for the children on the Start Date. If the provided ages were incorrect, you are responsible for any price increases.
30. Quoted Prices generally include:
– All park entrance fees and taxes
– Game safari to national parks as specified in your Itinerary
– Activities as specified in your Itinerary
– Hotel/lodge/camp accommodation and meals as specified in your Itinerary
– Unless specified otherwise, a private 4×4 wheel drive vehicle with a roof hatch and sliding windows
– Professional English-speaking tour guide/driver
– Water and hot drinks (coffee and tea) during the safari
31. Quoted Prices exclude any accommodation, service, or activity not specifically included in your Itinerary, such as:
– Any sightseeing excursions and optional activities other than those specified
– Any meals or drinks not specifically included
– Entry visas
– International flights
– Laundry
– Tips and gratuities
– Travel insurance
– Landing fees (for charter flights)
– Phone calls
– Toiletries and items of a personal nature
– Souvenirs
Surcharges
32. Worth of Africa reserves the right to levy a surcharge where costs have changed since the date you received the Booking Confirmation. Worth of Africa will absorb amounts up to 2% of the Quoted Price and surcharge any amount greater than 2%.
33. If the surcharge exceeds 10% of the Quoted Price, you are entitled to cancel the Tour and receive
